UK student visa route changes were introduced in the Statement of Changes to Immigration Rules on July 17, 2023.
The UK’s student visa changes address two main issues: limiting dependent family members’ access to UK students unless on a postgraduate research program, and introducing restrictions on switching to skilled workers and other sponsored work visas before course completion.
Dependant family members are no longer able to join except with exceptions
The UK government announced changes to the student visa route on May 23, 2023, as part of measures to limit net migration. The Statement of Changed introduced these changes on July 17, 2023, addressing net migration reduction:
- Starting January 1, 2024, international students can bring dependants only on research-designated postgraduate courses.
- For students starting on or after January 1, 2024, providers must confirm the course is a Ph.D. or research-based higher degree for dependent family eligibility.
A research-based higher degree is a postgraduate program with a larger research component than taught components, measured by student effort.
Students- Skilled Worker Transition Restricted
New immigration rules prohibit students from switching visas until they complete their courses. Previously, some students abandoned courses to apply for skilled workers or work visas before completing their studies.
Student Route Undergoes Significant Change:
Restricting international students from switching between student and work routes before completing studies.
Students with degree-level or higher courses can apply for skilled worker or sponsored visas before course completion, as long as their employment start date is not before course completion. Ph.D. students can switch after 24 months of study.
Students can switch to an Ancestry visa or Global Talent visa after completing a full-time Ph.D. with a higher education provider with a compliance track record and at least 24 months of study.
